Senior Care Centers — Stolen $1378.26 from me

Contract stated in two paragraphs that refunds upon death would be returned within 30 days. Dec 18, 2017 was date of death. First let me state I am not the military dependent, but my grandma was (Army). My grandma, passed away Monday, Dec 18, 2017. Per her contract that we signed prior to her Jan 14, 2014 move-in date when TriSun Healthcare owned Wyoming Springs Assisted Living in Round Rock, TX stated on page 11, Section III Fees Paragraph G, that “the community will pay…a refund of a prorated portion…for the month in which Resident vacates the Residence and when Resident or the Responsible party removes all personal property.” It also states “The community will pay any refunds within thirty (30) days after the Residence is completely vacated and all Resident’s personal property is removed.” Per the contract, we were out within 5 days (Dec 22, Friday). Since that day I requested the refund verbally three times…once to the Finance Manager Susan ***** who stated she would send the request to the General Manager Donna Hohm, once directly to Donna Hohm at Grandma’s Celebration of Life on February 10, 2018, and on April 9 when I was put through to Donna’s voicemail, leaving my cell number. I never received responses from any of the verbal requests (and based on others’ complaints online about Senior Care Centers regarding refunds, I don’t expect to). I sent Donna follow-up email dated March 6, 2018 at 9:54AM, an email to Susan ***** at 10:10AM same day after receiving Donna’s out of office response, and another follow-up email sent March 12, 2018 at 7:52AM. I’ve received no responses from any of these, either. I have the original contract we signed that mentions the 30 day refund on page 11 as well as page 13, Section V. End of term Paragraph B. I also have the emails that I have sent. My mom can show the bank statements where checks were written Dec 1, 2017 for $747.34 and Dec 5 for $4,000 totaling the monthly payment of $4,747.34. Divide that by 31 days = $153.14 per day. Dec 23 – 31 = 9 days that Grandma was not in the facility which is $1378.26 that we are owed by Wyoming Spring Assisted Living/Senior Care Centers LTC. This is well outside of the 30 day window. There is no number for me to contact anyone at headquarters, and I can’t get a response directly from Wyoming Springs. I can forward the unanswered emails I have sent, if that will help the investigation.
